Introduction
These Terms of Service ("Terms") govern access to and use of Outbooked websites, waitlist experiences, applications, lead-facing pages, advisor tools, integrations, communications, and related services (collectively, the "Service") operated by Outbooked LLC ("Outbooked," "we," "us," or "our").
By accessing or using the Service, creating an account, joining the waitlist, or accepting these Terms through another presented flow, you agree to these Terms. If you do not agree, do not use the Service.
2) Waitlist and Pre-Launch Access
Joining the Outbooked waitlist is free, does not require payment, and does not create a subscription, customer account, guarantee of access, reservation, priority entitlement, or obligation to purchase. Waitlist timing, invitations, beta participation, and availability are determined by Outbooked.
If you consent to launch and product updates, we may contact you using the information submitted. You may unsubscribe at any time. Operational confirmation of a waitlist registration may still be sent as a transactional message.
3) Accounts and Roles
The Service may support advisors, firm or organization administrators, team members, leads, and internal administrators. You are responsible for accurate account information, credential security, authorized users, and activity under your account.
We may suspend, restrict, or terminate access that violates these Terms, fails payment or entitlement checks, creates legal or security risk, misuses the Service, or may harm users, connected platforms, or third parties.
4) The Service
Outbooked provides appointment-pipeline software for financial advisors and firms. Depending on availability, plan, configuration, geography, and connected services, features may include:
- advisor onboarding, website intelligence, brand context, and product configuration
- product catalogs, qualification rules, enrichment questions, and product-linked campaigns
- AI-assisted campaign, quiz, advertising-plan, copy, and creative workflows
- lead capture, advisor-branded quizzes, personalized results, readiness language, and educational pathways
- video assignment, watch tracking, page activity, lead timelines, and pipeline signals
- email nurture, transactional email, SMS appointment communications, suppression, and unsubscribe handling
- native booking, calendar connections, appointment management, and external booking links
- advisor dashboards, analytics, lead exports, team seats, organization administration, and billing tools
- managed Meta advertising setup, review, launch controls, measurement, attribution, and optimization workflows
- embeddable campaign experiences and related public lead pathways
Features may be in preview, change, require separate approval, depend on third parties, be limited by plan, or be discontinued. Website descriptions are summaries and do not guarantee that every feature is available to every user.
5) Software Platform; No Financial Advice
Outbooked is a software company. Outbooked is not an investment adviser, broker-dealer, custodian, bank, insurer, insurance producer, tax adviser, law firm, accounting firm, or compliance consultant. We do not provide financial, investment, insurance, tax, legal, accounting, suitability, fiduciary, or compliance advice.
Content generated, hosted, scored, routed, or displayed through the Service is educational and operational. It does not constitute a recommendation to buy, sell, or hold a financial product or security and does not replace professional judgment or required supervision.
6) Advisor and Firm Responsibility
Advisors and firms are solely responsible for reviewing and approving their campaigns, questions, answers, disclosures, advertisements, creative, emails, SMS content, booking flows, product descriptions, qualification criteria, and other public or client-facing materials before use.
You are responsible for all laws, regulations, professional obligations, firm policies, supervisory requirements, platform policies, licenses, approvals, recordkeeping, consent, and disclosures applicable to your business. Compliance-aware safeguards or validation do not guarantee regulatory compliance, firm approval, suitability, or acceptance by any regulator, carrier, broker-dealer, registered investment adviser, advertising platform, or other organization.
7) Inputs, Content, and AI-Assisted Outputs
"Inputs" include information or content submitted to the Service, such as advisor profiles, websites, brand assets, product details, campaign settings, prompts, quiz answers, lead information, booking details, and connected-account configuration. "Outputs" include content generated, assembled, scored, recommended, summarized, or displayed through the Service.
You retain rights you have in Inputs. Subject to applicable law and third-party rights, Outbooked assigns to you any rights it may have in Outputs generated specifically for you. You grant Outbooked a non-exclusive, worldwide, royalty-free license to host, copy, process, transmit, store, modify, and display Inputs and Outputs as reasonably necessary to provide, secure, support, troubleshoot, and improve the Service.
AI-assisted Outputs may be inaccurate, incomplete, non-unique, misleading, non-compliant, or unsuitable. You must independently review and verify Outputs before using them with leads, clients, firms, regulators, carriers, advertising platforms, or the public. We do not use non-public customer Inputs or Outputs in public marketing without permission.
8) Lead Data and Communications
Advisors and firms may access lead information generated through their campaigns and booking flows, including contact information, quiz answers, product or planning context, qualification indicators, video engagement, page visits, booking activity, and email or SMS engagement. Advisors and firms are responsible for using that information lawfully and maintaining required notices, consents, records, and supervisory controls.
You may not use the Service to collect Social Security numbers, full financial account numbers, medical records, or other highly sensitive information unless Outbooked expressly supports that use in writing. Communications may include account, support, booking, security, lead-access, nurture, analytics, and appointment-related messages. Marketing communications must include required preference or unsubscribe mechanisms.
9) Third-Party Platforms and Connected Accounts
If you connect or configure services such as calendar providers, managed advertising providers, Meta, Stripe, email or SMS providers, video platforms, external booking tools, AI or media-processing services, or other platforms, you authorize Outbooked to access, store, process, and use the data, tokens, credentials, and permissions reasonably necessary to provide the requested feature.
Third parties control their services, APIs, policies, fees, availability, review requirements, enforcement, and data practices. Outbooked is not responsible for platform changes, downtime, rejected advertising, account restrictions, content removals, lost spend, penalties, or other third-party actions. You may disconnect supported accounts where available or contact us for assistance.
10) Acceptable Use
You agree not to:
- use the Service for unlawful, deceptive, discriminatory, fraudulent, abusive, or misleading activity
- upload or publish content you do not have the right or authorization to use
- present generated content as individualized financial or professional advice without independent authorization and responsibility
- bypass access controls, access another account, scrape, overload, reverse engineer, or interfere with the Service
- use Outputs without appropriate human review, professional judgment, disclosures, and compliance checks
- send unlawful or non-consensual email or SMS communications
- submit malware, harmful code, or data intended to disrupt the Service
- use connected platforms in violation of their terms, permissions, or applicable law
11) Payments, Subscriptions, Seats, and Taxes
Joining the waitlist is not a purchase. When paid access is offered, Outbooked may use Stripe to process payments. By purchasing a subscription or seat, you authorize Outbooked and Stripe to charge your payment method for disclosed fees, renewals, seat quantities, taxes, and other charges associated with your plan.
Unless stated otherwise at purchase, subscriptions are billed in advance and renew automatically until canceled. You may cancel to stop future renewal. Cancellation does not automatically entitle you to a refund or credit for the current billing period. Firm plans may include seat limits, managed accounts, shared billing, and organization administration.
12) Refunds and Billing Disputes
Refunds, if any, are governed by the Refund Policy incorporated into these Terms. If you believe you were billed incorrectly, contact support@outbooked.ai promptly so we can review the issue before initiating a payment dispute.
13) Intellectual Property and Feedback
Outbooked and its licensors own the Service, including software, designs, workflows, templates, systems, trademarks, documentation, and underlying technology. Except as expressly allowed, you may not copy, modify, distribute, sell, lease, sublicense, or create derivative works of the Service. If you provide feedback, you grant Outbooked the right to use it without restriction or compensation.
14) Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUTBOOKED DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, ACCURACY, AND RELIABILITY.
OUTBOOKED DOES NOT GUARANTEE THAT THE SERVICE OR OUTPUTS WILL BE ERROR-FREE, UNINTERRUPTED, COMPLIANT, ACCEPTED BY THIRD PARTIES, OR SUITABLE FOR A PARTICULAR ADVISOR, LEAD, PRODUCT, CAMPAIGN, OR REGULATORY ENVIRONMENT. WE DO NOT GUARANTEE LEADS, QUALIFIED PROSPECTS, APPOINTMENTS, ATTENDANCE, REVENUE, ASSETS UNDER MANAGEMENT, RETURN ON AD SPEND, OR OTHER BUSINESS OR FINANCIAL OUTCOMES.
15) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUTBOOKED LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, ADVERTISING SPEND, BUSINESS OPPORTUNITY, OR PLATFORM ACCESS.
OUTBOOKED’S TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO OUTBOOKED IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
16) Indemnification
You agree to indemnify, defend, and hold harmless Outbooked LLC and its personnel, contractors, affiliates, and licensors from claims, losses, liabilities, damages, costs, and expenses arising from your Inputs, approved or used Outputs, campaigns, advertisements, communications, booking flows, connected accounts, professional services, regulatory obligations, violation of these Terms, or violation of applicable law or third-party rights.
17) Suspension and Termination
Outbooked may suspend or terminate access if you violate these Terms, fail payment or entitlement checks, create security or legal risk, misuse the Service, or if required by law or a third-party platform. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, limitations, indemnification, dispute resolution, and payment obligations.
18) Governing Law and Dispute Resolution
These Terms are governed by California law, excluding conflict-of-law rules. Before filing a claim, contact support@outbooked.ai and allow 30 days for informal resolution.
If a dispute cannot be resolved informally, you and Outbooked LLC agree to binding individual arbitration administered by the American Arbitration Association under its applicable rules, except that either party may bring an eligible individual claim in small claims court. Arbitration will take place in Los Angeles County, California, or remotely where permitted. Claims may be brought only individually, not as a class, collective, or representative action.
You may opt out of arbitration by emailing support@outbooked.ai within 30 days of first accepting these Terms and clearly stating that you are opting out of arbitration.
19) Changes to These Terms
We may update these Terms as the Service, law, or business changes. We will revise the "Last updated" date and provide additional notice where required. Continued use after an update takes effect constitutes acceptance of the updated Terms.
